Terms of Service

These terms are the agreement between you and Mocally for the use of our website-building and hosting service. Please read them, and contact us if anything is unclear.

1. The agreement

By using Mocally, requesting a website, or subscribing to a plan, you agree to these terms. If you are agreeing on behalf of a business, you confirm you are authorised to do so. If you do not agree, please do not use the service.

2. The service

Mocally prepares a personalised website for your business, sends you a preview, and makes changes you request by chat or messaging. We also offer optional paid services, including hosting on your own domain, editing sessions, enquiry handling and other tools described on our pricing section.

The service is provided as described at the time you subscribe. We may improve or change features, and we will not materially reduce what you have paid for without telling you.

3. Your free website

Preparing your first website and downloading it are free. No account or payment is required to see a preview.

A hosted preview is available for 7 days. After that the preview link expires.
Your download does not expire. Once you download your site, the files are yours to keep and host, with no obligation to us.
We may decline a request or withdraw a preview if these terms are breached.

4. Plans, payment and setup

Paid plans are billed monthly or annually in advance. Annual plans are charged for ten months, giving you two months free.
Prices are shown on our pricing section and are exclusive of any taxes that may apply.
A one-time setup fee may apply, covering domain connection, Google Business Profile claim and your first round of corrections. It is waived on annual plans.
Payments are handled by our payment provider. By subscribing you authorise recurring charges until you cancel.
If a payment fails, we may pause hosting or tools until it is resolved. We will tell you before doing so where we can.
We may change prices with reasonable notice. Changes apply from your next billing period, and you can cancel before then.

5. Your content and your responsibilities

You keep ownership of the content you provide, such as your text, logos and photos. You are responsible for ensuring that:

you have the right to use everything you send us, including images and trade marks;
your content is accurate and not misleading, and complies with advertising and consumer law;
your content does not infringe anyone else's rights or break any law; and
any claims you make about your business, prices and availability are truthful and kept up to date.

We may remove or refuse content that we reasonably believe breaches these terms or the law.

6. Licence to build and host your site

You grant us a licence to use, copy, adapt and display your content for the purpose of building, hosting, backing up and supporting your website. This licence lasts as long as you use the service, and ends when you close your account, except for content we must retain by law.

7. Acceptable use

You agree not to use Mocally to:

publish unlawful, defamatory, fraudulent, hateful or adult content;
mislead customers, for example with fake reviews or false claims;
send spam or distribute malware;
infringe intellectual property or privacy rights;
attempt to break, overload or gain unauthorised access to our systems; or
resell the service as your own without our written agreement.

If you breach this section, we may suspend or end your access. Where it is reasonable to do so, we will warn you first and give you a chance to fix the problem.

8. Domains

If you connect a domain you own, you remain responsible for it and for renewing it. Where we help register a domain on your behalf, we will tell you who the registrar is and any renewal costs. Domain registration is subject to the registrar's own terms.

9. Availability and support

We aim to keep hosted sites available at all times, but we do not guarantee uninterrupted service. Maintenance, third-party failures and events beyond our control may cause downtime. Support is available by email on working days; see our Support page.

10. Cancellation and refunds

You can cancel at any time from your account or by emailing us.
If you cancel, you keep access until the end of the period you have already paid for.
You can download your website files at any time, before or after cancelling. There is no lock-in.
Because the website is free to download, payments for hosting and tools cover time already served. If we have failed to deliver what was agreed, contact us and we will put it right or refund the affected period.
We may end or suspend your access for a serious or repeated breach of these terms.

11. Our intellectual property

Mocally, our name, logo, software and the systems we use to build websites remain our property or that of our licensors. These terms do not transfer ownership of them to you.

When you download your website, you receive the files and the right to use, host and modify them. Unless we agree otherwise, third-party stock images included in your site remain subject to their original licences.

12. Limitation of liability

Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for indirect or consequential losses, or for loss of profit, business, goodwill or data. Our total liability arising from the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

We provide the service with reasonable skill and care, but we do not guarantee particular results, such as search engine rankings or sales.

13. Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. If we make a significant change, we will tell you before it takes effect, and continuing to use the service means you accept the updated terms.

14. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless a mandatory consumer protection law in your country of residence gives you additional rights.
